Albany “Back to School” Competition - T&Cs ("COMPETITION RULES")
- Interpretation
- In these Competition Rules, the following definitions apply (unless the context clearly indicates a contrary intention):
- “the Consumer Protection Act” means the Consumer Protection Act, No 68 of 2008;
- “Competition Rules” means these rules, as required by section 36 of the Consumer Protection Act;
- “Participant” means an individual who enters the Promotional Competition and meets the criteria set out in terms of clause 4.1;
- “Participating Products” means any of the following:
- Albany Superior White Bread 700g
- Albany Superior Brown Bread 700g
- Albany Best of Both White Bread 700g
- Albany Best of Both Genius Bread 700g
- Albany Everyday White Bread 700g
- Albany Everyday Brown Bread 700g
- “POPI” means the Protection of Personal Information Act, No 4 of 2013;
- “Promoter” means Tiger Consumer Brands Limited, registration number 1972/006590/06;
- “Promotional Competition” means the competition to which these rules pertain to as run by the Promoter during the Promotion Period;
- “Promotion Period” means the period starting on 15th February 2021, at 00.00 and ending on 28th February 2021, at 23:59. No entries will be accepted or considered outside of the parameters of the Promotion Period;
- “Prize” means any prize awarded to a Winner in terms of this Promotional Competition as further described in clause 7; and
- “Winner” means a Participant who is successful in the Promotional Competition and is notified as such by the Promoter in terms of clause 7.
- Introduction
- The Promoter is offering a Promotional Competition in terms of which the Participants can enter the Promotional Competition in order to win the Prize, in terms of the Competition Rules set out herein.
- The Consumer Protection Act
- The Competition Rules contain certain terms and conditions which may:-
- limit the risk or liability of the Promoter, or any relevant third party; and/or
- create risk or liability for the Participant; and/or
- compel the Participant to indemnify the Promoter or a relevant third party; and/or
- serve as an acknowledgement, by the Participant, of certain facts.
- The Participant
- The Participant must be;
- a natural person and may not be a juristic person;
- 18 years or older; and
- a permanent resident or citizen of the Republic of South Africa.
- The Participant, by entering into the Promotional Competition, expressly acknowledges that he/she has been given an appropriate opportunity to first read the Competition Rules before entering the Promotional Competition and that he/she understands and thereby agrees to the Competition Rules.
- It is a material term of the Promotional Competition that all Participants participate entirely at their own risk.
- No director, employee, agent or consultant of the Promotor(s), or their spouses, life partners, business partners or immediate family members, or the supplier of goods and services in connection with this Promotional Competition may participate in this Promotional Competition.
- Campaign duration
- The campaign will run from 07:00 on the 15th February 2021 to 23:59 on the 28th February 2021. No entries will be accepted or considered outside of the parameters of the Promotion Period.
- How to Enter
- Participants are required to purchase any Participating Product in order to be considered for the Promotional Competition as the Participating Products have unique codes inside the packs.
- A single entry with a unique code qualifies the Participant to be entered into the daily prize draw for R5000 cash as well as the chance to win school essentials vouchers to the value of R100 or R200.
- Once a Participant has entered 2 unique codes, the Participant qualifies to receive a R16,50 Albany bread voucher, to be redeemed by the Participant at the retailer selected by the Participant from the list of participating retail outlets.
- The R16,50 Albany bread voucher can only be redeemed by the Participant at the participating retailer selected by the Participant on the USSD line *120*12214#.
- The R16,50 Albany bread voucher will be sent via text message to the Participant once the Participant has qualified.
- Winners can use the R16,50 Albany bread voucher to redeem any Albany bread to the value of R16,50 or less.
- Should a Winner wish to use their R16,50 Albany bread voucher to purchase any Albany bread valued at more than R16,50, the Winner will be required to pay the excess amount.
- Should a Winner use their R16,50 Albany bread voucher to purchase any Albany bread valued at less than R16,50, the Winner will not be able to claim the difference of the amount in terms of the Promotional Competition and the Promoter will not be liable to pay the Winner such amount.
- The R16,50 Albany bread voucher can only be used to redeem Albany bread.
- The issued R16,50 Albany bread voucher will expire within 14 days of being issued. Any voucher not redeemed within this time frame will be forfeited.
- Participants enter by dialing the USSD line *120*12214# and following the prompts to enter their unique codes.
- In terms of the Promotional Competition, only R10 million worth of free bread will be made available. Once bread to the value of R10 million has been redeemed, all subsequent entries will no longer qualify for a R16,50 Albany bread voucher irrespective of the fact that such entries fall within the parameters of the Promotion Period. To the extent that any entry is made after bread to the value of R10 million has been redeemed but during the Promotion Period, such entries will only count towards the daily prize draw for R5,000 cash and school essentials supplies vouchers.
- The Promoter is not liable for the failure of any technical element relating to this Promotional Competition that may result in an entry not being successfully submitted.
- Entries which are unclear, illegible or contain errors will be declared invalid and the Promoter shall not be liable for any such invalid entry.
- USSD sessions are charged from the Participant’s airtime or billing balance and cost 40c for every 20 seconds, or R1.20 per minute for MTN and Telkom customers, when the Participant uses the service (free minutes do not apply). Participants are required to terminate the call when complete in order to stop the call and terminate the USSD session.
- Virtual networks are excluded from entering.
- Data charges may apply.
- The Prize
- The Prizes include:
- The chance to win one of 14 x R5 000 daily cash prizes
- The chance to win one of 148 x school essentials vouchers to the value of R100
- The chance to win one of 148 school essentials vouchers to the value of R200
- 1 x R16,50 Albany bread voucher for every 2 unique codes entered, while stocks last.
- The Winners of the R5000 cash prizes will be selected by a random draw and will be notified telephonically on the cellphone number that the Winner used to enter the Promotional Competition within 72 hours of the selection having taken place. In the event that any of the Winners cannot be successfully contacted following all reasonable attempts to do so, the Promoter reserves the right to draw another Winner in substitution after 3 working days. The names of the Winners of the R5,000 cash prize and the school essentials vouchers will be available on the consumer care line and the Promoter’s Facebook page. Any queries in this regard may be directed to the Promoter’s consumer care line 0860101107.
- The Winners of the school essentials vouchers will be notified via SMS with their voucher code for their R100 or R200 Pick n Pay voucher. The voucher is valid until the 31 March 2021. Any queries in this regard may be directed to the Promoter’s consumer care line 0860 101107.
- Winners of the school essentials voucher will have until 23h00 on 31st March 2021 to redeem the Prizes at Pick n Pay stores.
- The Winner
- By participating in the Promotional Competition, the Winners hereby accept that the Winner may be asked to take part in further publicity relating to the Promotional Competition. The Promoter may, with the Winner’s prior written consent, incorporate the Winners in publicity campaigns or allow their names and likenesses to be used for promotional purposes aligned with the Promoter's business, including but not limited to posting photos and names of Winners to the Promoter's website, Facebook and other social media pages.
- The Winners may be required to sign a waiver of liability and indemnity before claiming their Prizes.
- All Winners will be required to provide the Promoter with their names, copy of their identity document, passport or driver’s license, proof of bank account, contact details and to sign an acknowledgement of receipt of the Prize.
- Winners of the R5 000 (five thousand rand) cash prize will be offered two options in receiving their money. Via direct deposit into a verified South African bank account, or via E-wallet payment, linked to the cell phone number they entered the competition with.
- In the event that any Winners cannot be successfully contacted following all reasonable attempts to do so, the Promoter reserves the right to draw another winner in substitution after 3 working days.
- The Participants consent, by taking part in the Promotional Competition, to the Promoter using the personal information collected through the Promotional Competition to adjudicate the Promotional Competition and for future marketing purposes by the Promoter themselves.
- Where Participants/ Winners consent to take part in the Promoter's publicity campaigns, they will not be entitled to any remuneration or compensation of any kind whatsoever for such participation and all materials arising from such participation will be the sole property of the Promoter.
- The Winners are final and no correspondence shall be entered into.
- The Competition Rules
- The following rules apply to the Promotional Competition:-
- the Participants must provide correct and up-to-date personal details as required by the Promoter and allow the Promoter to process such information in terms of POPI;
- the Promoter reserves the right to amend these Competition Rules by bringing it to the Participants attention within a reasonable period of time and may terminate the Promotional Competition at any time. In such event, where the Promotional Competition is terminated or suspended, all Participants agree to waive any rights that they may have in terms of the Promotional Competition and acknowledge that they have no recourse against the Promoter, its employees, agents, partners, suppliers, or sponsors; and
- in the event of a dispute between the Promoter and a Participant/Winner, the decision of the Promoter will be final and binding and no correspondence will be entered into. In this regard and for the avoidance of doubt, the Promoter shall be entitled to deal with such disputes (or any failure by Participants/Winners to follow the Competition Rules) in its sole discretion, including that the Promoter shall be entitled to immediately disqualify Participants/Winners from this Promotional Competition.
- Unlawful, fraudulent, or otherwise dishonest conduct or any conduct in breach of the Competition Rules by a Participant/Winner determined in the Promoter’s sole discretion, may result in disqualification from the Promotional Competition and ineligibility to win any Prize.
- Participants can only enter the Promotional Competition on a phone that is owned by the Participant and registered in the name of the Participant. No person can use a phone that is registered in another person’s name to enter the Promotional Competition. If it is discovered that a Participant has entered the Promotional Competition with a phone that is not registered in the name of the Participant, the Participant/Winner will be disqualified and will be requested to refund the Prize(s) to the Promoter. In the event that the Participant/Winner is unable to refund the Prize(s) to the Promoter for any reason whatsoever, the Participant/Winner shall be required to refund to the Promotor an amount equal to the value of the Prize(s).
- Therefore, each Participant is expected to be the registered owner of the phone used to enter the Promotional Competition and no person can enter from a cellphone number that is not registered in the name of that person.
- The cellphone number is key to all entries and needs to be a number that is contactable during office hours.
- By entering this Promotional Competition, the Participant authorizes the Promoter to collect, store and use (but not share) personal information of the Participant for communication or statistical purposes.
- The Promoter reserves the right to extend, shorten or suspend the Promotional Period due to technical, commercial or operational reasons, public interest, events beyond its control or generally for any reason whatsoever within its sole discretion. In the event that the Promotional Period is extended, shortened or suspended, Participants will be notified by the Promoter as soon as reasonably possible through a notice on its website at www.Albany.co.za. All Participants who have received confirmation of a Prize prior to any suspension or shortening of the Promotional Competition will remain eligible to receive the Prizes that have been awarded to them in accordance with these terms and conditions.
- Participants shall have no recourse or claim against the Promoter as a result of: (a) any amendment to these terms and conditions, (b) the cancellation, termination or suspension of the Promotional Competition in line with these terms and conditions and/or (c) the Promoter’s’ inability to reach the Participant, despite attempts in line with these terms and conditions, to reach a Participant.
- Indemnification
- By entering into the Promotional Competition, the Participant expressly agrees to the following indemnifications:
- the Participant indemnifies and holds harmless the Promoter and its promotional partners, their employees and their agents (“the Indemnified Parties”) of any and all liability pertaining to any damage, cost, injuries and losses of whatsoever nature and howsoever arising as a result of their participation in the Promotional Competition and related events and activities, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy; and
- the Participant accepts that the Indemnified Parties will not be responsible for any costs, damage or otherwise, howsoever incurred by the Winner subsequent to claiming the Prize.
- Prize Qualification Rules
- A Prize may not be handed over to a Winner when it is prohibited by law. Once the Winner has been notified and the Prize has been handed over, the Winner must sign an acknowledgement of receiving the Prize.
- The Winner agrees to participate in Albany’s marketing and communication activities related to the Prize they have won.
- The Winner must provide valid proof of identity (a green bar-coded ID book, passport or driver’s licence).
- Any extras not included in the Prize as detailed above will be at the expense of the Winner.
- The Promoter reserves the right to substitute the Prize with any other prize of similar commercial value to the Prize offered herein, at its sole discretion.

- POPI
- Winners agree to the use of their name and image by the Promoter in any publicity material.
- Any personal data relating to Winners or Participants will be used solely in accordance with the Consumer Protection Act and POPI, as the case may be, and will not be disclosed to a third party without the Winner or the Participant’s prior consent.
- This Promotional Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other social network.
- The Participant, by part taking in the Promotional Competition, consents to his/her personal information to be shared with the Promoter's employees, contractors or agents for the purpose of this Promotional Competition and for the purpose of sharing future promotions.
